Terms &
Conditions
These terms govern the use of hivroni.art and the purchase of works through it. They cover who you are contracting with, how prices and payment work, how a sculpture is packed and shipped, and your rights to cancel, return and be refunded under the Israeli Consumer Protection Law, 5741–1981.
Browsing the site, or placing an order through it, means you have read these terms and agree to them. If you do not agree, please do not use the site. Nothing here reduces any right granted to you by mandatory consumer law.
Introduction
1.1Welcome to hivroni.art, the studio site of the ceramic sculptor Guy Hivroni (in these terms: “the site”).
1.2Use of the site — including browsing the portfolio, purchasing a work and contacting the studio — is subject to the terms set out below (“the terms”).
1.3These terms are written in the masculine form for convenience only and apply equally to all genders.
1.4Section headings are for orientation only and do not affect the interpretation of the terms.
The parties
2.1The seller / site operator — Guy Hivroni, an independent ceramic artist, of Davidson 8, Jerusalem, Israel, who owns and operates the site and creates all works offered on it.
2.2The user — any person who visits the site, places an order, or otherwise makes use of its services.
2.3To place an order you must be at least 18 years old and hold a valid means of payment in your own name. The studio may ask to verify identity before confirming an order.
The works
3.1Every piece offered on the site is an original ceramic sculpture, hand-built and finished by the artist. Most works are unique; where a piece belongs to a limited series, that is stated on its page.
Because the works are made by hand and fired in a kiln, small variations in colour, glaze, surface texture and dimensions are inherent to the medium. They are a characteristic of the work — not a defect.
3.2Photographs on the site are taken with care to represent each work faithfully, but screen calibration differs between devices and exact colour cannot be guaranteed.
3.3Dimensions and weight shown on a work’s page are approximate and are given to the nearest centimetre.
3.4A work marked “Not for sale” is shown for reference only — it is part of the artist’s archive, a private collection or an exhibition, and is not available for purchase.
Orders
4.1Because most works are one of a kind, a piece is reserved for you only once the order has been paid for and confirmed. Adding a work to the cart does not reserve it.
4.2An order is complete when you receive a confirmation e-mail from the studio. That confirmation forms the contract between us.
4.3The studio may decline or cancel an order — and will refund any amount already charged in full — where the work has already been sold, where a price or description was displayed in error, where payment was not honoured, or where there is a reasonable suspicion of fraudulent use of a means of payment.
4.4If you notice a mistake in the details of an order you have placed, contact the studio immediately at hivroni@gmail.com; before the work has shipped, details can usually still be corrected.
Prices and payment
5.1Prices are shown in New Israeli Shekels (₪) to buyers in Israel and in US dollars ($) to buyers outside Israel. The currency shown at checkout is the currency you are charged in. Shekel prices include VAT at the statutory rate.
5.2Prices do not include shipping, and they do not include any import duty, tax or customs charge levied in the destination country — those are separate from shipping and are the buyer’s responsibility (see 6.6). Free collection from the studio is available in Israel. Where a delivery cost is shown at checkout, that is the amount you pay; where the shipping option is marked quote after order — which is the case for every international destination — the shipping cost is quoted for your address after the order and is paid separately, through a payment link we send you.
5.3The studio may change prices at any time, but the price binding on an order is the one displayed at the moment the order was placed.
5.4Payment is made through the payment methods offered at checkout — credit card and Bit — processed by PayMe over a secure, encrypted connection. The studio does not see or store card numbers.
5.5If your card is issued outside Israel, your bank may apply its own exchange rate and a foreign-transaction fee. These are set by your bank and are not charged by, or paid to, the studio.
5.6An invoice or receipt is issued for every order and sent to the e-mail address given at checkout.
Shipping and delivery
6.1The studio ships worldwide, subject to the availability of the carrier and to any restriction that applies to the destination. Every work is packed by hand in protective, custom packaging and is fully insured in transit for its purchase price. Packing is included in the shipping cost.
6.2Preparation. A work is prepared and dispatched within up to 5 business days of all payments for the order — including shipping, where it is quoted separately — having been completed. If a piece requires additional drying, firing or framing time, you will be told before the order is confirmed.
6.3Transit times after dispatch. These are estimates given by the courier and do not include customs delays or any other delay outside the studio’s control:
- Within Israel — usually 2–5 business days.
- International — usually 5–14 business days, depending on destination and customs clearance.
- Collection from the studio — from the studio in Jerusalem, by prior arrangement and at no charge. The exact address is given to you after purchase, when the collection is arranged.
6.4Business days are Sunday to Thursday, excluding Fridays, Saturdays, public holidays and holiday eves in Israel.
6.5A tracking number is sent to you as soon as the work is dispatched.
6.6Customs and import duties. On international shipments, any import duty, tax or customs handling charge levied by the destination country is payable by the buyer and is not included in the price. The customs declaration states the full sale value of the work, which is also the value it is insured for. Please check your local rules before ordering.
6.7The studio is not responsible for delay caused by the courier, by customs, by strikes, by force majeure, or where the buyer cannot be reached to arrange delivery. Where a delay is substantial, the studio will keep you informed and help pursue the matter with the carrier.
Cancellation, returns and refunds
7.1Cancellation rights follow the Consumer Protection Law, 5741–1981 and the Consumer Protection (Cancellation of a Transaction) Regulations, 5771–2010.
7.2You may cancel a purchase from the moment the order is placed and up to 14 days from the day the work reaches you.
7.3To cancel, contact the studio by e-mail at hivroni@gmail.com or by telephone at +972 54 559 7079, stating your name and order number.
7.4Cancellation not caused by a fault. The amount paid is refunded less a cancellation fee of 5% of the price of the work or ₪100, whichever is the lower. The work must be returned unused, undamaged and in its original packaging, and return shipping is at the buyer’s expense and risk — a sculpture should be returned in the same protective packaging it arrived in.
7.5Cancellation because of a fault — a work that arrives damaged, does not match its description on the site, or is not delivered on time — carries no cancellation fee. You are entitled to a full refund including the original shipping cost, and return shipping is at the studio’s expense.
7.6Refunds are made to the original means of payment within 14 days of the cancellation notice being received.
Under section 14C(d) of the Consumer Protection Law, a work made specially to the buyer’s order — a commission or a bespoke piece — cannot be cancelled once making has begun. This is set out again in section 09.
Condition, damage and care
8.1Every work is inspected and photographed before dispatch and leaves the studio intact and correctly packed.
8.2Ceramic is fragile. If a work arrives broken or damaged, keep the packaging and notify the studio within 14 days of delivery, with photographs of the work and of the outer box. Because every shipment is insured, the studio will handle the claim and will — at your choice, where the piece is unique — make a full refund including shipping, or agree a repair or a replacement work with you.
8.3This does not cover damage caused after delivery by dropping, unreasonable handling, outdoor exposure or cleaning contrary to the care instructions supplied with the work.
8.4Unless stated otherwise on its page, a work is intended as an indoor sculpture and is not food-safe, dishwasher-safe or frost-proof.
Commissions and bespoke works
9.1The studio accepts a limited number of commissions each year. A commission begins with a written agreement setting out the concept, approximate dimensions, timetable and price.
9.2A commission normally requires a non-refundable deposit of 50% of the price before work begins, with the balance due before dispatch.
9.3Because the work is created specifically for you, it cannot be cancelled once making has begun, in accordance with section 14C(d) of the Consumer Protection Law. The right to a remedy for a work that arrives damaged or materially different from what was agreed is unaffected.
9.4A commissioned work is a work of art, not a reproduction: the finished piece will follow the agreed concept, but the artist retains creative judgement over its execution.
Intellectual property
10.1All content on the site — the sculptures themselves, photographs, texts, the site design, its layout, logos and code — is the intellectual property of Guy Hivroni or of licensed third parties, and is protected by the Copyright Law, 5768–2007.
10.2You may view and share the content for personal, non-commercial purposes. Copying, reproducing, publishing, distributing, translating or making any commercial use of it requires the artist’s prior written consent.
10.3Purchasing a work transfers ownership of the physical object only. Copyright in the work, including the right to reproduce and photograph it for the artist’s portfolio, catalogues and exhibitions, remains with the artist.
10.4The buyer may photograph and display an acquired work privately, and may resell the physical object.
Limitation of liability
11.1The site and its content are provided “as is”. The studio makes every effort to keep information accurate and up to date, but does not warrant that the site will be free of error or continuously available.
11.2Except where the law provides otherwise, the studio’s liability in connection with an order will not exceed the amount actually paid for that order.
11.3The studio is not liable for indirect or consequential loss arising from use of the site.
11.4Nothing in this section limits liability for personal injury, for fraud, or for anything else that cannot be limited under Israeli law, nor does it reduce your rights under the Consumer Protection Law.
11.5If any provision of these terms is found to be invalid, that provision alone will be severed and the remaining terms will stay in force.
Links to external sites
12.1The site may link to external sites, including social-media profiles and the payment provider.
12.2The studio has no control over those sites and is not responsible for their content, their privacy practices or their availability. Following such a link is at your own responsibility.
Privacy and accessibility
13.1Personal information collected through the site is handled as set out in the Privacy Policy, which forms part of these terms.
13.2The site is built to comply with Israeli Standard 5568 and with WCAG 2.1 level AA, and carries an accessibility tool that lets you adjust text size, contrast, spacing and navigation. Full details, and how to report a barrier, are in the Accessibility Statement.
Changes to these terms
14.1The studio may update these terms from time to time.
14.2A change takes effect only once published on this page, and the “last updated” date at the top shows when that was. An order already confirmed remains governed by the terms in force when it was placed.
Governing law and jurisdiction
15.1These terms are governed by the laws of the State of Israel.
15.2Exclusive jurisdiction over any dispute arising from them lies with the competent courts of the Jerusalem District.
15.3Before turning to a court, we ask that you contact the studio directly — almost every question is resolved in a single conversation.
